Back in 2008, Kentucky Governor Steve Beshear sued in Franklin Circuit Court to give the state control of 141 domains that had been regarded as if they were gambling devices like slot machines.

The Circuit Court scheduled a forfeiture hearing during which only the owners of the domains could prove their points against the seizure. And later the gaming trade association which claimed to have amongst their members the owners of most of the 141 domains obtained from the Kentucky Court of Appeal a writ that prohibited the forfeiture of the domains.

According to the latest ruling of the Kentucky Supreme Court, trade groups like the iMEGA and the IGC lacked standing to pursue the writ as they never revealed which domain owners they represented.

“The cyber-age status of their members does not let IMEGA and IGC escape traditional standing requirements” reads the ruling. “IMEGA and IGC lack standing and therefore their writ petition should have been denied.”

Kentucky’s Justices then added: “This is not to say that the failure to establish standing in this writ action completely forecloses relief by a way of writ in the future.”

In other words: if the domains owners come forward, the writ petition to block the forfeiture could be re-filed with the Court of Appeals and the Supreme Court would then accept it “as the merits of the argument have already been briefed and argued before it.”

A law introduced earlier in January, which made it illegal to operate an online gambling site without a local license, will ultimately result in blocking at least two hundreds web sites that allow Estonian citizens to gamble online. 

How many gambling sites does that leave for Estonian citizens to gamble on?  As of right now, exactly one – the Olympic Casino, which on January 21, 2010, was granted an online gambling license by the Estonian Tax and Customs Board. The first online gambling license in Estonia.  According to Olympic Entertainment Group, the operators of Olympic-Casino.com:
“At the moment Playtech’s gaming platform is being tested and the first legal online casino in Estonia will probably be opened within the next couple of weeks. Olympic Casino’s online environment will also include a poker room, which will give Estonians the first time opportunity to play at the world’s leading online poker network iPoker.”

And while Estonia’s online poker players are currently debating whether poker is gambling or a sport, local Internet Service Providers have received from the Estonian Government the first list of online gambling sites to block.

According to the Estonian Free Press, an online web site that provides independent news about Estonia, the list includes some 175 sites amongst which are the domains of some of the biggest internet poker companies such as Full Tilt Poker, PokerStars and PartyPoker, the world’s largest betting exchange Betfair and leading European bookmakers Bwin and Unibet.

“Estonian internet providers are now expected to disable accesses from Estonian IPs to all the rooms included in the list for not occurring into a 40,000 kroons fine for providing access to online gambling,” said the Estonian Free Press.
